Workday registration
Spanish companies are obliged to record their employees' working hours. This is a compulsory formula to guarantee control of working hours. This regulation was approved by the Cabinet on 8 March and published in the Official State Gazette (BOE) on 12 March 2019.
One of the indispensable elements is that the mechanism by which a company monitors its workers' working hours complies with the requirements established in the data protection law. If the company uses an application for this purpose, it must ensure that it complies with it. The data must be stored for a period of four years and can only be accessed by authorised managers of the company and the employee.
Art. 10 of Royal Decree-Law 8/2019 obliges the employer to keep the monthly summaries of the working time records for a minimum period of four years and make them available.
Telework Law
Telecommuting, understood as work that is carried out outside the usual establishments and centres of the company and of which teleworking is a subspecies that involves the provision of services with new technologies, has been the subject of regulation both domestically and in the Community and international spheres.
Law 10/2021, of 9 July, on teleworking. This law is also the result of social consultation, of a lengthy process of shared reflection and debate which, after more than three months, has culminated in the Distance Working Agreement (ATD), which ensures a fair balance in the regulation of distance working and which, without doubt, will determine its durability over time, as happens with all those changes that affect the labour sphere and come from the hand of consensus.
